Sales Tax Bar Association has filed an application before Hon’ble Delhi Court, in the pending Writ Petitions No. W.P(C) No. 9575/17 & W.P(C) No. 10284/18 [Sales Tax Bar Association v. Union of India] for the extension of date for filing Annual Return & Reconciliation Statement in FORM GSRT 9, GSTR 9A and GSTR 9C. The application has been filed in order to apprise the Hon’ble Court regarding the inefficient functioning/non-funtioning of the GSTN Portal when the due date is 31.01.2020.
The Hon’ble High Court in the last date of hearing had directed GSTN that considering the due date for the Annual Return the portal be immediately made properly functional but in disregard with the directions of the Hon’ble Court, the GSTN Portal is still funtioning extremely poor and has resulted in the either non-filing of the Return, or where returns are filed after hour and hours of struggle.
Sales Tax Bar Association had earlier wrote detailed representations to the Respondents in the Petitions highlighting the issues being faced by the tax payers and tax professionals all over India. In the representations numerous screenshots were also attached, which were shared by the tax payers and tax professionals all over India, on the Platform of Sales Tax Bar Association. Various representations which were written to the Hon’ble Finance Minister and to the Respondents requesting for the extension of the due dates and smooth functioning of the portal, were also the part of the detailed representations. However, after recieving no relief/ response from the Government, the Sales Tax Bar Association has filed urgent application seeking the intervention of the Hon’ble High Court of Delhi.
The application is likely to be listed hearing in the next week.
