A Writ Petition have been filed in the Hon’ble Delhi High Court on behalf of Sales Tax Bar Association (Regd.) & Anr. v. Union of India & Ors. challenging various technical glitches of the Common Portal of GSTN.
In this case submissions have been made from time to time to the Hon’ble Court regarding various technical glitches on the GSTN portal & on the direction of the Hon’ble Court the same have been discussed with the representatives of Government, GST Council and GSTN in multiple meetings. Various issues haven resolved by GSTN during these meetings/representations, and also by the High Court
The Hon’ble Delhi High Court on 13.12.2018 was pleased to pass the interim order regarding 3 issues submitted before the court on the date of hearing. The Hon’ble Delhi High Court has observed that:
- Government prima facie does not have the power to restrict the assessees from rectification in return, and accordingly, the Government has been asked to respond on the same.
- Likewise, the Hon’ble High Court has asked the Government to respond on how they can stop the assessees from rectifying the obvious errors. Eg. While applying for registration, a person who was mandatorily required to register might have by mistake selected voluntary registration.
- In reply to the issue regarding extension of due date of filing Annual Return the respondents informed that same has already been extended to 31.03.2019 prior to the date of hearing.
